Title Lien Search Checklist

Use this due diligence checklist to uncover municipal code violations and recorded property liens before you close on a distressed real estate deal.

  1. 1Pull a title commitment or title search from a licensed title company to identify recorded municipal liens.
  2. 2Search the county recorder / clerk of court for recorded code enforcement, nuisance, and abatement liens by parcel number.
  3. 3Request a code enforcement case history from the municipal code enforcement division by address or parcel ID.
  4. 4Check the city's online code enforcement / permitting portal for open violations and unpaid fines.
  5. 5Verify property tax status with the county tax collector — unpaid taxes create senior liens ahead of code liens.
  6. 6Order a municipal lien letter (often $25–$100) from the city for an official payoff figure.
  7. 7Confirm whether daily fines are still accruing and request a cure/compliance status in writing.
  8. 8Review the special magistrate / hearing officer docket for pending or past cases and any appeal deadlines.
  9. 9Ask the seller for any notices, citations, or correspondence from code enforcement.
  10. 10Re-run the payoff estimate with the Lien Payoff Estimator using the official lien letter figures.
